Please read these Terms carefully before using the website or placing an order. They set out the basis on which Recapita Metals supplies precious-metal products and explain the parties’ key rights and responsibilities.

1 Acceptance and eligibility

These Terms and Conditions govern access to www.recapitametals.in and purchases from Recapita Metals, operated by Recapita Metals (“we”, “us” or “our”). By using the website or placing an order, you agree to these Terms, our Privacy Policy and the applicable Cancellation, Return and Refund Policy. You must be at least 18 years old and legally capable of entering into a contract.

2 Products and specifications

We sell gold and silver coins, bars, cards, artefacts and related products as displayed on the website. Product photographs are illustrative; colour, finish, dimensions and packaging may vary slightly. The product page and invoice will state the relevant metal, fineness, net weight and certification or hallmarking details, where applicable.

A difference of up to 0.050 gram may arise between weighing instruments or due to permitted measurement tolerance. This does not limit any right relating to a material shortage, incorrect specification or non-compliance with applicable law.

3 Precious metal prices

Prices are linked to precious-metal rates and may change without notice. The price applicable to an order is the price displayed and accepted at checkout, subject to payment realisation and our order confirmation. A product added to the cart is not price-locked.

If a price, tax, description or system error is identified, we may cancel the affected order before dispatch and refund the amount received. We will not substitute a product or charge an additional amount without your consent.

4 Orders and acceptance

An order placed on the website is an offer to purchase. An automated acknowledgement does not constitute acceptance. We may accept or decline an order based on availability, payment verification, delivery feasibility, transaction limits, KYC or fraud checks, or legal requirements. The contract of sale is concluded when we issue an order confirmation or dispatch the product, whichever occurs first.

5 Payment and verification

Payments must be made through the methods offered at checkout. Orders will be processed only after successful payment authorisation or realisation. You must provide accurate billing, delivery and contact information.

For high-value or unusual transactions, we may request PAN, identity, address, source-of-funds or other information required by law, our payment partner or reasonable fraud-prevention controls. Failure to provide satisfactory information may result in cancellation and refund after applicable verification.

6 Taxes and invoices

Prices will be displayed as inclusive or exclusive of taxes as stated at checkout. Applicable GST, delivery charges and other disclosed charges will form part of the final amount. A tax invoice will be issued in accordance with applicable law. You are responsible for providing the correct name, address, PAN and GSTIN, where relevant, before invoicing.

7 Delivery

We deliver to serviceable locations through third-party logistics providers. Delivery timelines are estimates and may be affected by verification, availability, public holidays, security procedures or events beyond our reasonable control. Please ensure that an authorised adult is available to receive and acknowledge the insured or secured shipment and provide any required delivery OTP or identification.

Risk in the product passes upon recorded delivery to you or your authorised recipient. If tracking shows delivery but the package was not received, notify us promptly at recapitametals@gmail.com / +91 9109954980.

8 Packaging and inspection

Coins or products supplied in sealed cards, capsules, tamper-evident packs or certificates should not be removed, altered or damaged if you may need to raise a return or authenticity claim. Opening or damaging such packaging may affect eligibility for return where the product cannot thereafter be verified or resold, except for a latent defect or any right that cannot legally be excluded.

Inspect the outer package before accepting delivery. If it appears tampered with or materially damaged, record the condition and, where practical, refuse delivery. Photographs or an uninterrupted unpacking video may help us investigate a claim, but their absence will not by itself defeat a genuine claim available under applicable law.

9 Cancellation returns and refunds

Because precious-metal prices fluctuate, an order ordinarily cannot be cancelled after it has been confirmed or processed. A change of mind or a subsequent change in market price is not a valid ground for cancellation or return.

If you receive an incorrect product, a materially damaged item, a material weight or purity discrepancy, or a product that does not match the confirmed specification, contact us within 48 hours of delivery at recapitametals@gmail.com / +91 9109954980, with the order number and available evidence. Keep the product, certificate, invoice and all packaging intact while the claim is reviewed.

After verification, we may arrange replacement, return or refund as required by applicable law and the circumstances. Approved refunds will be initiated to the original payment method, ordinarily within 7 to 10 business days; the final credit time depends on the bank or payment provider. Nothing in these Terms limits mandatory consumer rights.

10 Customer responsibilities

You must not misuse the website, submit false information, impersonate another person, attempt unauthorised access, interfere with security, scrape content at scale, or use the website for unlawful or fraudulent activity. You are responsible for protecting your login and payment credentials and for promptly reporting suspected unauthorised activity.

11 Intellectual property

The website, brand names, logos, product content, photographs, layout and other materials are owned by or licensed to us. You may use them only for personal, non-commercial purposes connected with the Services. No licence or right is granted except as expressly stated.

12 Third party services

Payments, communications and deliveries may be provided by independent third parties under their respective terms. We remain responsible for our obligations as the seller, but are not responsible for a third party’s separate service or website except to the extent required by applicable law.

13 Disclaimer and limitation of liability

We aim to keep website information accurate and the Services available, but do not guarantee uninterrupted or error-free access. To the extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from website use, delivery delay or events beyond our reasonable control.

Our aggregate liability for a particular order will ordinarily not exceed the amount paid for that order. This limitation does not apply to fraud, wilful misconduct, personal injury caused by negligence, breach of mandatory consumer rights, or any liability that cannot legally be limited.

14 Force majeure

We will not be responsible for delay or failure caused by events beyond our reasonable control, including natural disaster, epidemic, war, civil disturbance, government restriction, banking or payment-network disruption, cyber incident, transport interruption or courier failure. We will take reasonable steps to minimise the effect and communicate material delays.

15 Governing law and disputes

These Terms are governed by the laws of India. Subject to mandatory consumer jurisdiction, courts at Bhopal, Madhya Pradesh will have jurisdiction. Before initiating proceedings, the parties should first attempt to resolve the matter through the grievance process below. Consumers may also use remedies available under the Consumer Protection Act, 2019 and applicable rules.

17 Changes to these Terms

We may update these Terms to reflect changes in law, products or business processes. The revised version will be posted on the website with the updated effective date. Terms applicable to an accepted order will not be changed retrospectively unless required by law or agreed with you.
